I ❤️ is Not a Trademark!


The General Court of the European Union (July 9, 2025, cases T-304/24, T-305/24, and T-306/24) has confirmed the refusal to register the "I ♥" sign as an EU trademark for use on clothing.


The EUIPO had concluded that this sign, immediately perceived as the expression "I love," lacked distinctiveness and did not serve to identify the origin of the products. The placement of the sign (on the chest, neck, or label) did not confer any additional distinctiveness.


As a result, the appeals filed by the German company sprd.net have been rejected.
